It's mostly due to the fact that nobody bothered to think about future repercussions for these western licensing deals when they were hashing them out and the different court systems in Japan/America.
Biggest example is the Studio Nue/Tatsunko/Harmony Gold clusterfuck when it comes to the licensing of Macross.
